Terms and Conditions for Art Space Art Fair Applicants
By submitting your application, you confirm that you have read, understood, and agree to these Terms and Conditions.
1. General
1.1. By submitting an application to participate in the Art Space Art Fair (“the Eventâ€), you agree to abide by these Terms and Conditions.
1.2. Art Space Ltd reserves the right to update these Terms and Conditions at any time, and any changes will be communicated to applicants via email or our website.
2. Application Process
2.1. Applicants must complete the official application form and provide accurate and truthful information.
2.2. Required information includes, but is not limited to: full name, email address, website/portfolio link, social media handles, city/country of residence, and confirmation of consent to receive updates.
2.3. Submission of an application does not guarantee acceptance into the Event. Art Space Ltd will notify successful applicants via email.
3. Eligibility
3.1. Applicants must be 18 years or older.
3.2. Submissions are open to visual artists working in painting, sculpture, photography, and mixed media.
4. Fees and Costs
4.1. Any participation fees or additional costs associated with the Event will be communicated to successful applicants.
4.2. Artists are responsible for their own shipping, insurance, and travel arrangements.
5. Intellectual Property
5.1. All artwork remains the intellectual property of the artist.
5.2. By applying, you consent to Art Space Ltd using images of your submitted work for promotional purposes, including social media, event materials, and website content.
6. Withdrawal
6.1. If you are accepted and later unable to participate, you must notify Art Space Ltd as soon as possible.
6.2. Withdrawal after a specified deadline (to be communicated upon acceptance) may result in forfeiture of any fees paid.
7. Liability
7.1. Art Space Ltd will take reasonable care to ensure the safety of exhibited works but accepts no liability for damage, loss, or theft. Artists are advised to arrange their own insurance.
7.2. Art Space Ltd is not responsible for delays, cancellations, or changes to the Event caused by circumstances beyond its control.
8. Privacy
8.1. By submitting an application, you consent to Art Space Ltd collecting, storing, and processing your personal data in accordance with our Privacy Policy.
8.2. Data collected will only be used for purposes related to the Event and communication from Art Space Ltd.
9. Compliance
9.1. All artists must comply with any rules or guidelines provided by the Event organisers, including setup and takedown schedules, space usage, and conduct during the Event.
9.2. Failure to adhere to these Terms and Conditions may result in exclusion from the Event without refund or compensation.
10. Communication Consent
By submitting this application form, you agree that, if successful, our team may contact you via email, phone, or WhatsApp to provide further information about the event, including available wall space and next steps for participation.

This Art Fair Exhibition Contract (“Agreement”) is made and entered into as of the date of the last signature below (“Effective Date”) by and between the following parties:

WHEREAS the Organiser is hosting two separate art fairs known as:
1 – Art Space Events London 2026 (“Art Fair 1”), at Old Billingsgate, London
2 – Art Space Events Marbella 2026 (“Art Fair 2”), at Villa Padierna, Marbella

WHEREAS the Exhibitor is an Artist, Gallery, or representative wishing to participate in the Art Fair selected above and display works of art in a designated exhibition space.
NOW, THEREFORE, in consideration of the mutual covenants and promises herein contained, the parties agree as follows:

1.1 The Organiser shall provide the Exhibitor with an exhibition space (“Booth”) measuring approximately (please select),

at the Venue for the duration of the Art Fair.
- The location and allocation of Booths will be confirmed at the time of booking but the Organisers reserve the right to make changes when operational needs are required, we will however make reasonable effort to accommodate the Exhibitor’s preferences.
- The Exhibitor shall not assign, transfer, or sublet all or any part of the Booth without the prior written consent of the Organiser.

2. Artwork Display and Conduct
2.1 The Exhibitor agrees to display only original works of art or other items approved by the Organiser.
2.2 All works must be installed and dismantled during the setup and breakdown periods designated by the Organiser and in accordance with the Organiser’s rules and regulations. If you are an artist all the set up will be handled by the Organiser’s. If you are a gallery the setup must be completed by the gallery. This includes price labels and biographies which are needed for every piece of art.
2.3 For a Gallery Exhibitor you responsible for the installation, display, and removal of their works and materials.
2.4 The Gallery Exhibitor shall maintain their Booth in a clean and orderly condition and comply with all applicable laws, regulations, and venue rules.
2.5 The Exhibitor shall not engage in any conduct that, in the Organiser’s sole discretion, is disruptive, unsafe, or detrimental to the reputation or operation of the Art Fair.

3. Fees and Payment

- The Exhibitor shall pay to the Organiser an exhibition fee (“Fee”) of [amount and currency], payable as follows:
33% deposit upon signing this Agreement.
33% due no later than 90 days prior to the exhibition date.
Remaining balance 30 days prior to the exhibition date.
- All payments are non-refundable except as expressly stated herein.
- The Organiser reserves the right to deny access to the Art Fair if payment is not received in full by the deadline.
- Late Payments: Interest will be charged at the statutory rate in the applicable jurisdiction (UK: 8% + Bank of England base rate; Spain: legal interest rate plus applicable surcharge). Late payment charges will be proportionate to actual administrative costs.

4. Sales and Commissions

- The Exhibitor may offer artworks for sale during the Art Fair, subject to applicable laws and regulations.
- Artists Only: The Organiser shall receive a commission of 25% on all sales made during the Art Fair or as a direct result of participation therein.
- If the Exhibitor is a Gallery, then the commission rate is 0%.
- The Gallery Exhibitor is responsible for the collection and remittance of all taxes, duties, or fees associated with the sale of artworks.
- Payments to Artists will be made within 30 days of the closure of the event.

5. Insurance and liability
5.1 The Exhibitor is responsible for insuring their artwork, fixtures, and other property against damage, loss, or theft.
5.2 The Organiser shall not be responsible or liable for any loss, damage, or theft of the Exhibitor’s property at any time.
5.3 The Exhibitor agrees to indemnify and hold harmless the Organiser, its employees, agents, and contractors from any claim, suit, or liability arising from the Exhibitor’s participation in the Art Fair or acts or omissions of the Exhibitor.

6. Promotion and Intellectual Property

- The Organiser may photograph, film, or otherwise record the Art Fair and the Exhibitor’s Booth and artworks for promotional, archival, or media purposes.
- The Exhibitor grants the Organiser a non-exclusive, royalty-free license to use images of exhibited works and the Exhibitor’s name, likeness, and biographical information for the promotion of the Art Fair and related activities.
- The Organiser shall not acquire any ownership of copyright in the Exhibitor’s works

7. Set Up, Break Down and Timetable

- A Gallery Exhibitor will be allowed access to the Venue for setup. An unloading/loading slot will be allocated nearer to the exhibition date. It is imperative that your slot is adhered to as no other slots will be available.
- Gallery breakdown will be also a timed slot system and Exhibitors will be informed of their time slots nearer to the event date.
- Any works or property left after the breakdown period may be removed and stored by the Organiser at the Exhibitor’s expense.

8. Force Majeure
8.1 If the Art Fair is cancelled or postponed due to circumstances beyond the Organiser’s reasonable control (including but not limited to acts of God, epidemic, government regulation, fire, flood, or labour disputes), the Organiser shall not be liable for any costs or damages incurred by the Exhibitor.
8.2 In such events, the Organiser will make reasonable efforts to reschedule the Art Fair and, at their discretion, may refund fees paid by the Exhibitor minus any unrecoverable costs.

9. Termination
9.1 The Organiser may terminate this Agreement with immediate effect if the Exhibitor breaches any material term, engages in unlawful or unethical conduct, or otherwise endangers the safety, operation, or reputation of the Art Fair.
9.2 Upon termination, the Organiser may remove the Exhibitor and their property from the Venue, at the Exhibitor’s cost and risk, without liability.
9.3 The Exhibitor may terminate this Agreement by written notice to the Organiser; however, any fees paid are non-refundable except as otherwise provided herein.

10. Cancellation of Space
10.1 If the Exhibitor wishes to cancel, they must send written notice by recorded delivery or confirmed email.
10.2 Cancellation fees will reflect the Organiser’s actual losses and will be reduced if the stand is resold. The maximum charges are:
- More than 9 months before the Event: 33% of the total price.
- Between 3 and 9 months before the Event: 50% of the total price.
- Less than 3 months before the Event: 100% of the total price.
10.3 Requests to reduce booked space must be made in writing. The Organiser may apply cancellation charges in proportion to the space reduction.

11. Artwork Requirements & Delivery and Collection of Artwork
11.1 All Artist artworks must be delivered to the address provided by the Organiser before the stated deadline (unless otherwise agreed).
11.2 Collection: Artists Artworks will be available for pickup 15 working days after the Event unless previously agreed with the Organisers.
11.3 Whilst every care will be taken the Organisers cannot guarantee that the artworks will be packaged in the same way they were delivered in.
11.4 Return shipping costs are the responsibility of the gallery.
11.5 The Artist must upload the details of their artwork to the Organisers portal and must supply biographies, hi-res images, titles, and RRP of every piece.
11.6 All artwork must be supplied in a professional framed manner unless otherwise agreed with the Organisers. Artwork supplied unframed or damaged will not feature.
11.7 All artworks must be supplied with the correct hanging hardware on the back of the pieces. Any artwork that does not meet this requirement will not feature in the art fair.
11.8 All artworks must be delivered with foam corner protection on all sides of the frames. The Organisers will not accept any liability for damage if this is not adhered to.

12. Miscellaneous
12.1 This Agreement, including all exhibits and attachments, constitutes the entire understanding between the parties and supersedes any prior agreements.
12.2 Any modification to this Agreement must be in writing and signed by both parties.
12.3 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction].
12.4 Notices under this Agreement shall be made in writing to the addresses listed above.

13. Payment Details
13.1 – An exhibitor has only secured a place at the Art Fair once the 33% deposit is paid. The full balance is needed to grant the Exhibitor access to the Art Fair. If the balance is not cleared it is understood that the Exhibitors stand will be removed. 13.2 Deposit payments to be sent to:
